1. Acceptance of these Terms

By accessing or using this website (the “Site”), you (“User”, “you”) agree to be bound by these Terms and Conditions (the “Terms”). If you do not agree to these Terms, you must not use the Site.

If you use the Site on behalf of a business or other legal entity, you represent and warrant that you have authority to bind that entity and that it accepts these Terms.

2. About Us and Our Role

This Site is operated by Ketchup Your Credit, a business operating in the Province of British Columbia, Canada (“Ketchup Your Credit”, “we”, “us”, “our”).

Our services are limited to:

• Collecting information you choose to provide and forwarding that information to participating third‑party automotive dealerships or finance providers (“Dealers”) so they may contact you about potential financing or related products.

• Providing access to online tools, including a debt repayment calculator and budget tool (collectively, the “Calculators”).

• Providing informational links and/or referral pathways to third‑party service providers such as KOHO (the “Third‑Party Providers”).

We are not a lender, financial institution, bank, credit union, insurance company, or financial adviser, and we do not make credit decisions, provide financing, or provide personalized financial, tax, or legal advice.

3. No Affiliation with Dealerships, Lenders, or KOHO

Dealers and Third‑Party Providers (including KOHO) are independent third parties and are not our partners, agents, representatives, employees, or affiliates. Any reference or link to a third party on the Site is provided only as a convenience to you and does not constitute:

• An endorsement or recommendation of that third party or its products or services.

• Any guarantee, warranty, or representation regarding that third party, its suitability, or the terms of any product or service it may offer.

We do not:

• Negotiate, arrange, or approve financing or credit.

• Review or verify the accuracy of any information, terms, or offers provided by Dealers or Third‑Party Providers.

• Assume any responsibility for any communications, agreements, contracts, credit applications, credit decisions, or transactions between you and any Dealer or Third‑Party Provider.

Any relationship between you and a Dealer or Third‑Party Provider is solely between you and that third party, on the terms you agree with them. You are solely responsible for reviewing and agreeing to any separate terms, conditions, consents, disclosures, or privacy policies that those third parties may require.

4. Forwarding of Your Information

When you submit information through the Site (for example, contact information, vehicle interests, or basic financial information), you authorize Ketchup Your Credit to:

• Collect that information; and

• Forward or otherwise provide that information to one or more Dealers or Third‑Party Providers so they can contact you about potential products or services.

You confirm that:

• All information you provide is true, accurate, and complete to the best of your knowledge.

• You have the authority to provide that information.

• You understand that Dealers and Third‑Party Providers may rely on the information you provide when deciding whether to contact you or offer products or services.

We do not control how Dealers or Third‑Party Providers use your information once it has been provided to them. Their use of your information is governed by their own privacy policies, terms, and applicable laws, not by these Terms. You should carefully review their policies before proceeding with any application, account opening, or transaction.

5. Calculators and Budget Tools – Educational Use Only

The Calculators and any budget tools available on the Site are provided for general information and educational purposes only. They are:

• Self‑help tools meant to help you model different scenarios.

• Based on assumptions and simplified models that may not reflect your actual situation, current interest rates, lender criteria, tax rules, or other relevant factors.

You acknowledge and agree that:

• The outputs, estimates, or projections from the Calculators are examples only and may be inaccurate, incomplete, or inapplicable to your circumstances.

• The Calculators do not constitute financial, investment, tax, accounting, or legal advice and are not a substitute for advice from a qualified professional.

• You are solely responsible for evaluating the results and for any decisions you make based on those results.

Ketchup Your Credit makes no representation or warranty regarding the accuracy, completeness, or suitability of any Calculator outputs, and does not guarantee that any modeled scenario can or will be achieved.

6. No Financial, Tax, or Legal Advice

The content on the Site, including any articles, FAQs, examples, or explanatory text, is general information for educational purposes only. It is not intended to:

• Provide personalized financial, credit, investment, tax, or legal advice.

• Take into account your specific objectives, financial situation, or needs.

7. User Responsibilities

You agree that you will:

• Use the Site and the Calculators for lawful purposes and in compliance with all applicable federal, provincial (including British Columbia), and municipal laws and regulations.

• Not rely solely on information or tools from this Site when making significant financial decisions, and instead seek appropriate professional advice where needed.

• Review and understand the terms, conditions, fees, interest rates, and other details of any product or service offered by a Dealer or Third‑Party Provider before agreeing to it.

You are solely responsible for:

• Any actions you take or fail to take based on the Site or any referrals made through the Site.

• Any contracts or arrangements you enter into with Dealers or Third‑Party Providers.

8. No Guarantee of Approval, Offers, or Outcomes

Ketchup Your Credit does not:

• Guarantee that any Dealer or Third‑Party Provider will contact you.

• Guarantee that you will be approved for financing, credit, or any particular product or service.

• Guarantee any interest rate, loan amount, repayment term, or other outcome.

All financing and product decisions are made solely by the relevant Dealer or Third‑Party Provider in accordance with their own policies and applicable law. Any projections or examples on the Site (including Calculator outputs) are illustrative only and are not a promise or guarantee of any specific result.

9. Third‑Party Links and Content

The Site may contain links or access to third‑party websites, services, calculators, or content (including KOHO and other Third‑Party Providers). These are provided for your convenience only.

Ketchup Your Credit does not:

• Control or operate such third‑party websites or services.

• Endorse or guarantee any information, products, or services available through them.

Your use of third‑party sites and services is at your own risk and is subject to the terms and privacy policies of those third parties, not these Terms.

10. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Site, its content, the Calculators, and any services provided through the Site are provided on an “as is” and “as available” basis without any representations, warranties, or conditions of any kind, whether express, implied, statutory, or otherwise.

Without limiting the generality of the foregoing, Ketchup Your Credit disclaims all implied warranties or conditions of:

• Merchantable quality.

• Fitness for a particular purpose.

• Non‑infringement.

• Accuracy, reliability, or completeness.

We do not warrant that:

• The Site or Calculators will be accurate, current, complete, uninterrupted, secure, or error‑free.

• Any defects or errors will be corrected.

• The Site will be free of viruses or other harmful components.

Any use of the Site or downloading of materials is at your own risk, and you are solely responsible for any damage to your device or loss of data.

11. Limitation of Liability

To the maximum extent permitted by the laws of British Columbia and Canada, in no event will Ketchup Your Credit, our directors, officers, employees, contractors, or agents be liable for any:

• Indirect, consequential, incidental, special, punitive, or exemplary damages.

• Loss of profits, loss of savings, loss of data, loss of business, or loss of opportunity.

• Damages arising out of or in connection with:

  • Your use of, or inability to use, the Site, the Calculators, or any content.

  • Any referrals to, or dealings with, Dealers or Third‑Party Providers (including KOHO).

  • Any contracts, transactions, or disputes between you and any Dealer or Third‑Party Provider.

In all cases, our total aggregate liability to you for any claims arising out of or relating to the Site or these Terms will be limited to one hundred Canadian dollars (CAD $100), even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain damages or implied warranties. To the extent that such laws apply to you, some of the above exclusions or limitations may not apply; however, our liability will be limited to the maximum extent permitted by applicable law.

12. Indemnity

You agree to indemnify, defend, and hold harmless Ketchup Your Credit and our directors, officers, employees, contractors, and agents from and against any and all claims, demands, actions, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the Site or the Calculators.

• Your provision of information through the Site.

• Your dealings, communications, or agreements with any Dealer or Third‑Party Provider.

• Your breach of these Terms or violation of any applicable law.

13. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, disclose, and protect your personal information. By using the Site, you consent to the collection, use, and disclosure of your personal information in accordance with our Privacy Policy and applicable privacy laws, including the Personal Information Protection Act (British Columbia) and, where applicable, the Personal Information Protection and Electronic Documents Act (Canada).

14. Eligibility and Jurisdiction

The Site is intended for use by residents of Canada, with a focus on residents of British Columbia. You are responsible for ensuring that your use of the Site complies with the laws of the jurisdiction where you reside or from which you access the Site.

These Terms and your use of the Site are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without giving effect to conflict of laws principles. You agree to submit to the exclusive jurisdiction of the courts of British Columbia for all disputes arising out of or related to the Site or these Terms.

15. Changes to the Site and Terms

Ketchup Your Credit may modify, suspend, or discontinue any part of the Site, the Calculators, or any other features at any time without notice.

We may also update or revise these Terms from time to time. When we do so, we will change the “Last Updated” date at the top or bottom of this page. Your continued use of the Site after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree with the changes, you must stop using the Site.

16. Termination

We may, in our sole discretion, suspend or terminate your access to the Site at any time and for any reason, without notice or liability to you.

Upon termination, all provisions of these Terms that by their nature should survive termination (including, without limitation, ownership provisions, warranty disclaimers, limitations of liability, and indemnity) shall survive.

17. General

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.

No waiver of any provision of these Terms will be effective unless in writing and signed by Ketchup Your Credit. Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer these Terms, in whole or in part, without notice to you.
